Terms of Service

1. Eligibility

You must be at least 13 years old, or the minimum age required to use the Service in your jurisdiction, to use Drift. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that you are not barred from using the Service under applicable law.

2. Your account

Some features of the Service require you to create an account, typically using your phone number and a verification code. You agree to provide accurate information and to keep it current. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your account credentials, device, and any access codes.

The Service may only be used within the scope of these Terms and applicable law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

4. Location sharing and safety

Drift is a location-based social app. Features such as maps, place presence, arrival detection, and friend visibility depend on location and related permissions that you control on your device. You decide when and with whom you share, including by using visibility controls such as Ghost Mode where available, and you can disable permissions at any time in your device settings.

You are responsible for your own safety and for how you choose to share your location and interact with others. Drift does not verify the identity of users and is not responsible for the conduct of any user, online or offline. Use good judgment when meeting people or sharing your whereabouts. If you ever feel unsafe, contact local emergency services.

5. User content and license

"User Content" means the photos, videos, captions, comments, profile details, and other content you create, upload, or share through the Service. You retain ownership of your User Content.

By submitting User Content, you grant Drift a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for example, to resize or reformat), display, and distribute that content solely to operate, provide, improve, and promote the Service consistent with your settings and the audience you select. This license ends when your User Content or account is deleted, except for content others have re-shared, content retained in backups for a limited time, or where retention is required by law.

You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms or the rights of any third party. We may, but are not obligated to, review, remove, or restrict content or accounts that we believe violate these Terms or applicable law.

6. Intellectual property

The Service, including its software, design, text, graphics, logos, and the "Drift" name and marks, is owned by Drift or its licensors and is protected by intellectual property laws. Except for the limited license granted to you in these Terms, we reserve all rights. You may not use our names, logos, or branding without our prior written permission.

7. Messaging and SMS consent

By using the app and providing your phone number, you agree to receive messages from us, including verification codes and service-related communications. Message and data rates may apply, and message frequency varies.

Carriers and the service provider are not liable for delayed or undelivered messages. Opting out of certain messages, such as verification codes, may prevent you from using parts of the Service.

8. Privacy

Our Privacy Policy explains how we collect, use, and disclose information when you use the Service. By using the Service, you agree to the collection and use of information as described in the Privacy Policy. Please review it carefully.

9. Third-party services

The Service relies on third-party providers and platforms, including app stores, push notification services, mapping and place-data providers, and cloud infrastructure. Your use of those services may be subject to their own terms and policies. We are not responsible for, and do not endorse, the content or practices of third parties.

10. Modifying and terminating the Service

We are constantly changing and improving the Service. We may add, change, suspend, or remove features, or discontinue the Service in whole or in part, at any time. We may also suspend or terminate your access to the Service if you violate these Terms, create risk or legal exposure for us, or for any other reason consistent with applicable law.

You may stop using the Service at any time and may request account deletion using any in-app tool we provide or by contacting us. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, indemnification, and dispute resolution.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that location data, place information, or other content will be accurate, complete, or reliable. You use the Service at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, Drift and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, Drift's total liability for any claim relating to the Service will not exceed the greater of the amount you paid us to use the Service in the twelve months before the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Drift and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. To the extent permitted by law, you and Drift agree to first try to resolve any dispute informally by contacting us. If a dispute is not resolved, you and Drift agree that disputes will be resolved on an individual basis and that, to the maximum extent permitted by law, you waive the right to participate in a class action or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property or unauthorized-access claims.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide additional notice where required. Your continued use of the Service after an update means the updated Terms apply to your use of the Service, to the extent permitted by law.
